Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Captive Thought LLC (“BritePath,” “we,” “us,” or “our”), a South Carolina limited liability company. These Terms govern your use of BritePath Pro and BritePath (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
If you are accepting these Terms on behalf of an organization (for example, as a co-op administrator), you represent that you have the authority to bind that organization to these Terms.
1. Description of Service
BritePath Pro is a web-based platform designed to help homeschool co-ops manage their operations, including scheduling, course enrollment, attendance, grades, messaging, and related organizational tasks.
BritePath is a companion application for personal family homeschool management. BritePath and BritePath Pro share a common account system, meaning your login credentials work across both applications.
Both applications are management tools. We are not an educational institution, a childcare provider, or a substitute for professional educational services. We are not responsible for the operations, decisions, or activities of any co-op or family that uses our platform.
The service is currently provided free of charge. We reserve the right to introduce paid features or subscription plans in the future. If we do, we will provide advance notice and existing functionality will not be removed without a reasonable transition period.
2. Eligibility
You must be at least 13 years old to create an account on BritePath Pro. Student accounts for children under 13 may only be created and managed by a parent, legal guardian, or an authorized organization administrator acting with parental consent.
3. Accounts and Registration
Accounts on BritePath Pro are created through invitations sent by organization administrators. You are not able to self-register.
When you create or manage an account, you agree to:
- Provide accurate and complete information
- Keep your login credentials secure and not share them with others
- Notify us if you believe your account has been compromised
- Accept responsibility for all activity that occurs under your account
Parent and guardian accounts. If you create a student account for your child, you are responsible for that account and any activity associated with it.
Administrator-created accounts. Organization administrators may create accounts on behalf of families and students. By doing so, administrators represent that they have obtained appropriate consent from the parent or guardian.
4. Organization Administrator Responsibilities
If you are an organization administrator, you have additional responsibilities:
- Data stewardship. You are responsible for the data your organization enters into BritePath Pro. You determine which members have access and at what permission level through the platform’s role and permission system.
- Member consent. You are responsible for ensuring that families in your organization understand how their data is used and that you have appropriate consent before entering their information, particularly for children. If your organization enables features that involve student interaction (such as messaging), you must obtain verifiable parental consent before enabling those features for any student account.
- Data ownership. Your organization retains ownership of its data. BritePath processes this data on your behalf to provide and improve the service. We do not sell or share your data with third parties for their own purposes. After deletion, we may retain anonymized or aggregated data that can no longer be linked to your organization, as described in Section 12.
- Accurate information. You are responsible for keeping your organization’s data accurate and up to date.
5. Acceptable Use
You agree not to:
- Use the messaging feature to harass, bully, threaten, or intimidate other users
- Upload or share content that is illegal, obscene, defamatory, or harmful
- Attempt to access accounts, organizations, or data that you are not authorized to access
- Interfere with or disrupt the operation of the service
- Use the service for commercial advertising or solicitation unrelated to your co-op’s activities
- Attempt to reverse-engineer, decompile, or extract source code from the platform
- Use automated tools (bots, scrapers, etc.) to access the service
We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice, depending on the severity of the violation.
6. User Content
“User Content” refers to any information, messages, or photos that you submit through the service.
- Ownership. You retain ownership of your User Content.
- License. By submitting User Content, you grant BritePath a limited, non-exclusive license to store, display, and transmit that content as necessary to operate the service. This license ends when your content is deleted.
- No monitoring obligation. We do not proactively monitor User Content, but we may review content that is reported to us or that we reasonably believe may violate these Terms.
- Deletion. User Content may be permanently deleted when you delete your account or when your organization is removed from the platform. We are not obligated to retain or return User Content after deletion.
- Photo sharing. Photos can only be shared within the messaging feature and are visible to the participants of that conversation.
7. Children and Student Accounts
BritePath Pro takes the privacy of children seriously.
- No self-registration. Students do not create their own accounts. Student accounts are created by a parent, legal guardian, or an authorized organization administrator.
- Minimal data collection. For student accounts, we collect only the information necessary to provide the service. This typically includes name and date of birth, along with educational records such as grades and schedules that are managed by the organization.
- Messaging. Messaging is not available for student accounts unless explicitly enabled by the organization with parental consent.
- Parental access. Parents and guardians can view and manage their child’s data through their own account, and may request deletion of their child’s account by contacting us or their organization administrator.

8. Privacy
Your use of BritePath Pro is also governed by our Privacy Policy, which describes what data we collect, how we use it, and your rights regarding that data. By using the service, you agree to the practices described in the Privacy Policy.
9. Intellectual Property
BritePath Pro, including its design, code, user interface, documentation, and branding, is owned by Captive Thought LLC and protected by applicable intellectual property laws.
“BritePath” and “BritePath Pro” are service marks of Captive Thought LLC. You may not use our name or branding in a way that suggests endorsement or affiliation without our written permission.
You may not copy, modify, distribute, sell, or create derivative works based on the platform or any part of it.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that:
- The service will be available at all times or without interruption
- The service will be free of errors or defects
- Data entered into the platform (grades, schedules, attendance records, etc.) will be accurate — accuracy depends on the data entered by users and administrators
BritePath is not responsible for any decisions made by co-ops, administrators, parents, or students based on information displayed in the platform.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPTIVE THOUGHT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR INTERRUPTION OF SERVICE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claim arising from or related to these Terms or the service is limited to the amount you have paid us in the twelve (12) months preceding the claim. Since the service is currently free, this amount is zero.
If your jurisdiction does not allow the exclusion or limitation of certain damages, some or all of the above limitations may not apply to you, but they will apply to the fullest extent permitted by applicable law.
12. Account Termination and Data Deletion
By you. You may delete your account at any time from within the application. When you delete your account, your personal data is removed and your messages are anonymized in accordance with our Privacy Policy. If you are unable to delete your account through the application, you may contact us to request deletion.
By an organization. Organization administrators may request deletion of their organization and all associated data by contacting BritePath. Organization deletion is permanent and cannot be undone.
By us. We may suspend or terminate your account if we reasonably believe you have violated these Terms. Where possible, we will provide notice and an opportunity to address the issue before termination, except in cases of severe or repeated violations.
Data retention. After account or organization deletion, some data may be retained in anonymized or aggregated form for operational purposes. We take reasonable steps to delete or de-identify personal information following deletion, though residual copies may persist in system backups or logs for a limited period in accordance with our standard data retention practices and any applicable legal requirements.
13. Changes to These Terms
We may update these Terms from time to time. When we make changes:
- The updated Terms will be posted with a new effective date
- For material changes, we will require you to review and accept the updated Terms before continuing to use the service
- For non-material changes, your continued use of the service after the updated Terms are posted constitutes your acceptance
We encourage you to review these Terms periodically.
14. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict-of-law provisions.
Any disputes arising from these Terms or your use of the service shall be resolved in the state or federal courts located in South Carolina, and you consent to the personal jurisdiction of those courts.
Before filing any legal claim, we encourage you to contact us to attempt to resolve the issue informally. We will make a good-faith effort to address your concern.
15. General Provisions
- Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and BritePath regarding the service.
- Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment. You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
